Terms of Service
By downloading, installing, or using the RollSpawn mobile application ("RollSpawn", "the app", "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Service.
1. License
Ethan Wood ("we", "us", "our") grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use RollSpawn on devices you own or control, for personal, non-commercial use, subject to these Terms and the applicable app store (Apple App Store or Google Play) terms of service.
2. In-app purchases
RollSpawn offers a one-time in-app purchase ("Premium Unlock") for the price shown in the app at the time of purchase (currently $4.99 USD or local equivalent). Premium Unlock is a non-consumable entitlement tied to the Apple ID or Google account used to make the purchase and can be restored on any device signed into that account.
All in-app purchases are processed and managed by Apple or Google. Refund requests are subject to the refund policy of the relevant store. Use the "Restore Purchases" option in the app's Settings to re-sync entitlements on a new device.
3. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or disassemble the app, except to the extent allowed by applicable law.
- Use the app in a way that violates any applicable law or regulation.
- Attempt to circumvent in-app purchases, license checks, or any other security mechanism.
- Use the app to infringe the intellectual property rights of any third party.
4. Content licensing
RollSpawn uses content from the System Reference Document 5.2, licensed under the Creative Commons Attribution 4.0 International License (CC BY 4.0). This license allows redistribution and adaptation with proper attribution. RollSpawn is not affiliated with, endorsed by, sponsored by, or specifically approved by any tabletop RPG publisher.
5. User-generated content
Characters you create, notes you write, and other data generated by your use of the app ("User Content") remain your property and stay on your device. Exporting or sharing User Content (for example, by sending a PDF character sheet to a friend) is entirely at your discretion and subject to any terms of the platforms you share through.
6. Intellectual property
The RollSpawn name, logo, app design, source code, imagery, and any original text and visual elements are the property of Ethan Wood and are protected by copyright and other intellectual property laws. These Terms do not grant you any rights in our trademarks or trade dress.
7. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPATIBLE WITH EVERY DEVICE OR OPERATING-SYSTEM VERSION.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM (A) YOUR USE OF OR INABILITY TO USE THE APP; (B) ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA; OR (C) ANY OTHER MATTER RELATING TO THE APP.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP (IF ANY) IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $5 USD, WHICHEVER IS GREATER.
9. Changes to the app and to these Terms
We may update the app, change features, or release new versions at any time. We may also revise these Terms. Material revisions will be announced in-app and reflected in the "Last updated" date above. Continued use of the app after a revision takes effect constitutes acceptance of the updated Terms.
10. Termination
You may stop using the app at any time by uninstalling it. We may suspend or terminate your access to the app if we determine, in good faith, that you have materially breached these Terms. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will survive.
11. Governing law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the app will be resolved in the state or federal courts located in Ellis County, Texas, and you consent to their jurisdiction.
